Philadelphia Cerebral Palsy Attorney
Helping You Provide a Bright Future for Your Child After a Birth Injury
Cerebral palsy (CP) is a non-progressive condition that affects motor skills and functioning. Technically speaking, it is a group of disorders, as there are varying degrees and types of CP. It is caused by abnormal brain development or injury before or during birth and, while it is not necessarily always the case, medical malpractice often plays a role in the development of CP.
If you went through a difficult labor or delivery and your child was later diagnosed with cerebral palsy, you may have grounds for a birth injury claim.

What Causes Cerebral Palsy
As previously mentioned, CP is caused by brain damage before or at birth. Typically, this damage occurs when the infant’s oxygen supply is reduced or cut off, preventing adequate oxygen/blood from reaching the brain. While this is not always caused by medical malpractice, mistakes and negligence during the labor and delivery process can — and often do — lead to serious complications, including brain damage.
Some examples of how malpractice can lead to brain damage that, in turn, results in cerebral palsy include:
- Failure to properly monitor the baby’s heart rate
- Failure to notice or address signs of fetal distress
- Prolonged labor/failure to order an emergency C-section
- Improper use of forceps/vacuum extractor
- Negligent treatment or failure to treat maternal infections
- Failure to detect or address prolapsed umbilical cord
In any of these or similar situations, the baby can experience hypoxia (insufficient oxygen) or anoxia (lack of oxygen), leading to severe brain damage which, later, may result in cerebral palsy.
What are the Symptoms of Cerebral Palsy?
If you have noticed CP symptoms in your child—such as stiff or “floppy” muscles, exaggerated reflexes, involuntary movements, tremors, or failure to meet motor skill development milestones — it is important that you seek medical attention from a qualified doctor. Only a medical professional can diagnose cerebral palsy.
